On August 1st a new Civil and Commercial Code will enter into force. This mens forced portion will be reduced from 80% to 66% (still very high but in line with most South American forced portions), spouses will be able to choce to have a separation of assets regime, and divore rules will be liberalized. A very relevant change for anyone with clients or interests in Argentina.
I noticed the trust provisions now allow the trustee to also be a beneficiary. However, testamentary trusts cannot override statutory bequests under forced inheritance laws or “legitima”.
